What you may not know is that in December 2014, the European Court of Justice in Luxembourg, ruled that “clinical obesity may be classed as an impairment enjoying protection under the relevant rule” and that “employers need to initiate appropriate measures to remedy functional defects.”

This ruling was made as a result of Karsten Kalttoft taking action against Billund City Council for his dismissal in 2010. (Karten Kaltoft v. Komninernes Landsforening).Mr.Kaltoft was employed by Billund City Council as a child-minder, he weighed over 25 stones. Billund City Council repeatedly asked him to lose weight and when he failed to do so they sacked him, because in their opinion he could not look after children properly.

The fact that this ruling now applies across the EU, has implications for all employers, if a worker has a disability certain provisions must be made by the employer, reasonable adjustments to the working day are required, there is no upper limit for damages for employees dismissed because of their disability.

Responsible employers would want to provide a healthy working environment for their staff and weight management services are an integral part of this.

Quite apart from complying with legislation it is in the employer’s interest to look after their most vital equipment, their staff, and to cut down on absenteeism through illness.
